SPONSOR. This Contest is sponsored by Ampro Industries, Inc., Memphis, Tennessee. Sponsor reserves the right to cancel the Contest at any time and substitute another promotion in its place.

This Contest begins on August 1, 2009 and ends on October 31, 2009 at 12:00 am (the "Promotional Period"). WHO CAN PARTICIPATE? This Contest is open to all legal residents of the United States and District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses, Alaska and Hawaii, who are eighteen (18) years of age or older (void in Puerto Rico). Participation in this Contest constitutes entrant's full and unconditional acceptance of these Official Rules. WHO IS NOT ELIGIBLE TO PARTICIPATE? Employees and their immediate families (parents, brothers, sisters and children) of the Sponsor, its and their advertising and promotion agencies are not eligible to enter or win. HOW DO I ENTER? Enter on-line. There are two (2) ways to enter: enter on-line. ON-LINE METHOD: Access the Website during the promotional period and register for the Sweepstakes by following the instructions. Complete the Contest entry form and click to submit during the entry period. Only one entry per day is permitted for on-line entries regardless of the number of e-mail addresses the entrant may have. If for any reason the Internet portion of the Contest is not capable of running as planned, Sponsor reserves the right at its sole discretion, to terminate, modify or suspend the Contest. In the event of a dispute, eligible electronic entries will be considered made by authorized account owner of the email address submitted at the time of entry. All entries become the property of the Sponsor and will not be acknowledged or returned. False or deceptive entries or acts will render the entrant ineligible. HOW DO I WIN? During the Promotional Period, eligible entries received will be combined to create the entry pool. Prize Winners will be selected by judges selected by the Sponsor on approximately December 20, 2009, after the end of the Promotion Period. The odds of winning a prize will be determined by the number of entries received. If a winner declines to accept a prize, or in the event that a prize or prize notification is returned as undelivered, the winner will be disqualified and the Sponsor may elect, at its own discretion, to select an alternate winner. DISPUTES. Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Tennessee; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of Tennessee, without giving effect to any choice of law or conflict of law rules or provisions (whether of Tennessee or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Tennessee. AMPRO'S RIGHT TO USE COMMERCIAL. By submitting a commercial, Contestant irrevocably and unconditionally grants Ampro, its successors, licensees and assigns the right to use the commercial for any purpose deemed appropriate by Ampro. If a Contestant's features any person other than the contestant, then Contestant shall be responsible for obtaining permission from such person to use that persons name or image. If contestant cannot obtain and send written evidence of such person's permission to Sponsor , then Contestant is not eligible the contest winner. |
